Michael Merrifield motion for new trial denied

I have previously covered the case of Logan Shane Goodall, a West Virginia toddler who died as a result of extreme abuse. His mother, Pepper Eren, pled guilty to neglect resulting in injury; she is still in prison after receiving a one to ten year sentence. His mother’s boyfriend, Michael Merrifield, was convicted of first degree murder, child neglect, and sexual abuse by a parent or guardian. Merrifield is scheduled to be sentenced on May 1st.
Merrifield’s attorney has argued that he should receive a new trial. The judge, however, has denied his request to overturn the jury verdict.
What follows is an excerpt of the article from the Charleston Gazette:
During the trial, Rebrook and defense lawyer Mike Clifford had argued that prosecutors couldn’t prove their case because three people were in Logan Goodall’s home in Hurricane in the hours before he died: Merrifield, his brother Patrick, and Eren.
The motion denied Friday included a list of reasons the court should overturn Merrifield’s conviction or grant him a new trial.
One is that a medical expert called by prosecutors said the child’s fatal injuries were inflicted between 20 and 90 minutes before he died, meaning Eren could have still been with the boy when they occurred.
It also claimed that Patrick Merrifield tried to kill himself during the trial. Merrifield’s lawyers wrote in the motion that the court should have told jurors about the suicide attempt because it could be construed as a “tacit confession” to his part in the 2-year-old’s death.
Patrick Merrifield was supposed to testify in his brother’s defense during the trial, but he invoked his Fifth Amendment right against self-incrimination.
The lawyers argued that the court should have made him take the stand.
“Patrick Merrifield’s evidence would have been exculpatory for the defendant in that he would have testified that the morning of the death, he was unable to wake the defendant, and that thereafter Pepper Eren asked him to lie to police about the time that he left the house,” the motion states.
Merrifield’s lawyers also argued in the motion that the judge should have moved the trial to a different county because of media attention to the case.
Merrifield’s parents, Dr. John Merrifield and Diane Merrifield, are expected to face trial on April 14th. Dr. Merrifield allegedly treated Logan’s wounds during separate incidents in which he should reasonably have suspected abuse, including treating burns to his heels and buttocks, and repairing a tear to the child’s scrotum, but failed to report the injuries to the Department of Health and Human Resources (DHHR) as required by law. Diane Merrifield allegedly lied to investigators, saying she had never heard of the child or his mother, and that her son was a fisherman living on a houseboat in off the Carolina coast.
The Merrifields and DHHR have been sued by Logan’s biological father, Jeremy Goodall. Dr. Merrifield settled the suit for $775,000; the case against DHHR and Diane Merrifield is still pending.
I just read that Dr. Merrifield plead “No Contest” for that Mrs. M won’t be tried. Can you believe this??? Now all he gets is a short sentence and $3000.00 fine?? And probably won’t have to serve a day.!!!!!
Wow, that is a surprise, and not a positive one considering that had he done what he was supposed to do, that poor little boy would still be alive.

Just saw it on the 6pm news, April 7, 2008. Mr. Merrifield plead “No Contest.” They indicate charges against his wife, Diane, will be dropped; but that he could get 1 to 5 yrs. I doubt it. They didn’t say, but this may mean he can still practice medicine, depending on whether the Board of Medicine gets involved. Too bad he didn’t come to his senses earlier. Was probably blinded by parental love. So sad. He must have known that his son was the one harming Logan; but he just couldn’t put his medical oath above blind love for his own son. Michael was the kind of son that would try the patience/love of any parent. Mr. Merrifield may have been too nice of a parent for a son like Michael. And Logan paid the ultimate price

I grew up with Mike and he was a bad seed when he was a child. His parents were good parents but blind to the fact that their kids were monumental F$#K UPS. I honestly believe that money, in some cases, causes a parent to look the other way. Meaning they let their kids dictate what they did and had the abundance to do it. They were given the ability to grow up and be respectable people in society and instead they used what was given to them to self destruct and destroy those around them. I can’t believe that Mr. Merrifield would look the other way, but at the same time I know he and his wife loved their son, as much as a F-UP as he was and I’m sure that blinded him to the truth.
Mike was always good at making his parents believe that he had done no wrong or that he was in the wrong place at the wrong time. However, this does not excuse them from protecting someone else’s child. GOD rest Logan’s soul. I haven’t lived in West Virginia since I finish school in 1996 and moved away, and I haven’t seen Mike since High School (1993), but I know for a fact that he was diffinately capable of doing such an act. AS SICK AS IT SOUNDS I’m not surprised that he did these acts except for the sexual abuse charge. That one does surprise me because it does not sound at all like Mike. However, since he is sick enough to do the other things he most likely did (In my opinion) I have a hard time thinking he wouldn’t have gone the extra mile in this case.
Anyway, I felt I had to say something about this. I had just heard from my father that he had finally been convicted and I was reading the many posted articles, etc. on the trial. It affected me even more now than it did when it first broke 2 plus years ago because I am now the proud father of a beautiful 16 month old daughter. I couldn’t imagine anyone doing this to anyone, especially a child, it sickens me greatly. The authorities would be putting me in jail for doing to them what they did to my kid if that ever happened to me. Merrifield should be put to death in the same manner that he tortured that poor defenseless little boy. May his little soul rest in peace.
